Beta Version Notice
Emblema Live is currently in beta. We're actively developing and improving the platform based on user feedback. During this phase:
- New features are being added regularly
- Some functionality may change as we optimize the user experience
- We're working hard to ensure reliability, though occasional issues may occur
- Your feedback helps us build a better product
1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of Emblema Live ("the Service", "we", "our", or "us"), including any content, functionality, and services offered through emblema.live.
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to change or modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.
2. Beta Service Terms
2.1 Beta Status
Emblema Live is currently in beta. We're actively developing the platform and appreciate your participation in helping us improve it. During the beta phase:
- New features are continuously being added and refined
- We're working to ensure the best possible user experience
- Some features may evolve based on community feedback
- We recommend keeping backups of important data as a best practice
2.2 Feedback
Your feedback is valuable to us! By participating in the beta, you help shape the future of the platform. Any feedback, suggestions, ideas, or other information you provide about the Service may be used by us without restriction or obligation to provide compensation. By submitting feedback, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate your feedback into the Service.
2.3 Data Preservation
We do not guarantee data preservation during the beta period. While we implement security measures and backups, you acknowledge that data loss may occur. We strongly recommend maintaining your own backups of any important data you upload to the Service.
3. User Accounts and Registration
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access

4.2 Prohibited Conduct

- Harass, abuse, or harm other users
- Upload or share illegal, offensive, or inappropriate content
- Attempt to reverse engineer, decompile, or disassemble any part of the Service
- Use automated systems (bots, scrapers) to access the Service
5. User Content

You retain ownership of any content you submit, post, or display on the Service ("User Content"). You are solely responsible for your User Content and the consequences of posting it.
5.2 License Grant
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the Service.
5.3 Content Responsibility
You represent and warrant that:

- Your User Content does not violate any laws or infringe any rights
- Your User Content is accurate and not misleading

We reserve the right to remove or disable any User Content at any time, particularly where required to comply with legal obligations, safety concerns, or violations of these Terms. In most cases, we aim to provide notice when possible, though immediate action may be necessary in certain circumstances.
6. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are owned by Emblema Live and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Trademarks
"Emblema Live" and related logos are trademarks. You may not use these trademarks without our prior written permission.
6.3 License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or professional use as intended, excluding resale, redistribution, or white-labeling of the Service itself.
7. Service Disclaimer
7.1 Beta Service
The Service is provided "as is" during the beta period. While we strive to provide a reliable and useful platform, as with any software in active development:
- Features and performance are being continuously improved
- We work to address any issues promptly
- The Service is evolving based on user feedback
- We recommend following standard best practices like backing up important data
7.2 Your Use
You understand that this is a beta version and use the Service at your own discretion. We're committed to making it as reliable as possible while we continue development.
8. Limitation of Liability
8.1 Exclusion of Damages
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:
- Loss of data or loss of access to data
- Loss of profits, revenue, or business opportunities
- Service interruptions or downtime
- Changes to or removal of features
- Costs of procurement of substitute services
This applies whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages.
8.2 Maximum Liability
Our total liability shall not exceed the fees paid by you for the Service during the beta period (if any).
8.3 Mandatory Protections
Nothing in these Terms limits liability where such limitation is not permitted under applicable law, including mandatory consumer protection laws in your jurisdiction. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Emblema Live, its officers, directors, employees, agents, partners, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.
10. Data and Privacy

10.2 Your Data
As with any online service, we recommend keeping backups of important data. This is a standard best practice for all digital content.

We're working on data export tools to give you full control over your information. This feature will be available soon.
11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us or using account deletion features if available.
11.2 Termination by Us
We may suspend or terminate your access to the Service if you violate these Terms, for security reasons, or if we discontinue the Service. Where reasonably possible, we will provide advance notice. However, immediate termination may be necessary in cases of serious violations or security threats. This includes the right to terminate the entire beta program, in which case we will provide reasonable notice to all users.
11.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Your account and associated data will be handled according to our Privacy Policy, which includes:
- A 90-day grace period during which you can request account recovery
- Permanent deletion of your data after the grace period
- Retention of certain data if required by law (e.g., for tax or legal compliance)
- Anonymized, aggregated data may be retained for analytics purposes
Sections that by their nature should survive termination shall remain in effect, including disclaimers, limitations of liability, and indemnification provisions.
12. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
13.2 Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts located in Italy to resolve any legal matter arising from these Terms or the Service.
13.3 EU Users
If you are a consumer based in the European Economic Area, you may benefit from mandatory consumer protection provisions under the law of the country in which you reside.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by:

- Updating the "Last updated" date
- Sending you an email notification (if applicable)
Material changes will take effect 30 days after notice. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emblema Live regarding the Service.
15.2 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver.
15.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
15.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
15.5 No Agency
No agency, partnership, joint venture, or employment relationship is created between you and Emblema Live as a result of these Terms or your use of the Service.
